MODEL SERVICES

HOURLY BOOKINGS:

Minimum booking duration is one hour at the model’s hourly rate. The specified length of the job must be communicated at the time of booking, and the model must be compensated for the entire booked duration.

DAY BOOKINGS:

Day bookings are calculated on an 8-hour basis. The day rate should be established at the time of booking and remains fixed upon the model's arrival. The full day's fee is applicable even if the entire duration is not utilized. Half-day rates are based on a 4-hour booking.

TRAVEL TIME:

For locations outside the NYC metro area, the model will be compensated for mileage at the current government-appointed mileage rate.

MODEL CARE & SAFETY: The Business Model

All bookings must ensure the model is treated with respect and professionalism, prioritizing their safety, health, and well-being. The client is responsible for protecting and maintaining the model throughout the service, adhering to applicable laws and industry practices.

EXCLUSIVITY:

Unless otherwise specified in the booking confirmation, the arrangement is non-exclusive. The Business Model retains the freedom to offer similar services to other parties or competing products/brands. An additional fee is required for exclusive or semi-exclusive use of the model's image, restricting use for competing products or within specific territories. It is the client's responsibility to verify potential conflicts.

CANCELLATIONS:

- 24 hours prior to booking: Full fee
- 48 hours prior to booking: Half fee
- Bookings reduced within one working day: Full fee of the originally booked time is charged
- Compensation for travel expenses incurred by the talent is mandatory upon cancellation, regardless of the timeframe. Postponements are subject to negotiation.

Usage

Additional fees apply for using the model's image beyond the initial permitted use. This includes reproductions, adaptations, or drawings in conjunction with various media such as posters, billboards, online platforms (Instagram, Twitter, Facebook, YouTube, Flickr, Blogs), and other social networking websites. Unless otherwise agreed, additional fees cover a 6-month period from the booking date, limited to use in the United States for agreed-upon purposes. The Agency determines additional usage fees at its discretion.

 

General Terms and Conditions

Welcome to Chocolate Creations Graphic Design Services! Please carefully review the following Terms and Conditions before initiating any projects with us. By requesting designs or services, you acknowledge your agreement to these Terms and Conditions, recognizing that this constitutes a binding contract with payment obligations.

  1. Scope of Services:

    • These Terms and Conditions apply to all Contracts between the Client and Chocolate Creations for design, printing, copywriting, visual media, websites, brand identity, illustrations, images, and photography (Artwork).
    • The Company reserves the right to modify these Terms and Conditions without prior notice.
  2. Graphic Design: Digital

    • Services include Web Banners, Digital Ads, Social Media Ads & Graphics, Posters, Email Signature Graphics, Blog Headers, Photo Editing, E-commerce Graphics, Logos, etc.
    • Turnaround times vary from 4 days to 3 weeks, depending on the project. Websites may require additional time.
  3. Material Handling:

    • The Developer/Designer has the right to refuse handling:
      1. Unlawful or inappropriate media.
      2. Media containing viruses or hostile programs.
      3. Media constituting harassment, racism, violence, obscenity, harmful intent, or spamming.
      4. Media constituting a criminal offense or infringing privacy or copyright.

Payment Terms

  1. The Company may request a deposit from the Client before commencing work on their project or Artwork. If a deposit is requested, an invoice will be sent via email, and payment is expected. Remitting deposit funds indicates the Client's acceptance of the Terms and Conditions, entering into a contract with the Company.

  2. In the absence of a deposit request, the Client is deemed to accept the Terms and Conditions upon requesting services/work from the Company.

Cancellation Policy

If the Client requests Contract cancellation:

  • The Company will assess the cost of Artwork and services provided.
  • The Client will be invoiced for this amount, minus any deposits paid on the project to date.
